1. Introduction

This Privacy Policy describes how Fabgen collects, uses, shares, and protects information in connection with the website located at fabgen.ai (the "Site") and our outbound lead generation, sales development, and related services (the "Services"). It applies to information we collect from visitors to the Site, prospective clients, current clients, and individuals whose information is provided to us by clients for the purposes of running outbound campaigns.

By using the Site or the Services, you acknowledge that you have read and understand this Privacy Policy.

2. Information We Collect

2.1 Information you provide directly

We collect information you provide when you:

• Book a call via our Calendly scheduling link (name, email address, company, scheduling preferences, and any information you enter in the booking form);
• Contact us by email or phone;
• Engage our Services and enter into a Service Agreement (billing contact, payment information, and operational contacts);
• Share information necessary to run outbound campaigns on your behalf (your ICP definition, sample messaging, CRM exports, prospect lists, and similar inputs).

2.2 Information collected automatically

When you visit the Site, we and our third-party service providers may automatically collect:

• Log information such as your IP address, browser type and version, operating system, referring URL, and the dates and times of access;
• Device information such as device type, screen resolution, and language settings;
• Usage data such as the pages you view, the links you click, the videos you watch (via Wistia), and the time you spend on the Site.

2.3 Information from third parties

In the course of providing the Services, we obtain prospect contact information and firmographic data from publicly available sources and from licensed B2B data providers (including Clay and similar enrichment tools). We do this on behalf of our clients to identify, qualify, and reach decision-makers at target accounts in commercial trades and adjacent verticals.

3. How We Use Information

We use information for the following purposes:

• To provide the Services. Including running outbound email campaigns, scheduling meetings, building and maintaining target prospect lists, reporting on campaign performance, and routing replies to our clients.
• To communicate with you. Including responding to inquiries, sending operational and account communications, and providing the Services you have engaged us for.
• To operate, secure, and improve the Site. Including diagnosing technical problems, preventing abuse, detecting fraud, and improving content and functionality.
• To comply with law. Including responding to lawful requests by public authorities and enforcing our Terms of Service.

4. Legal Bases (EU/UK Visitors)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, we process personal data on the following legal bases: (a) performance of a contract with you or your organization; (b) our legitimate interests in operating and improving the Services and conducting B2B sales and marketing; (c) compliance with legal obligations; and (d) where applicable, your consent.

5. Sharing and Disclosure

We do not sell personal information. We share information only as described below:

• Service providers. We share information with third-party vendors that help us operate the Site and Services. Categories include hosting, scheduling (Calendly), video hosting (Wistia), email infrastructure and deliverability tooling (including Instantly and similar providers), data enrichment (Clay and similar providers), customer relationship management, and payment processing. These vendors are contractually required to use information only as necessary to provide their services to us.
• Clients. When we book a meeting or surface a reply for a client, we share the corresponding contact information and conversation context with that client so they can pursue the opportunity.
• Legal and safety. We may disclose information when we believe in good faith that disclosure is required by law, regulation, legal process, or governmental request; to protect the rights, property, or safety of Fabgen, our clients, or others; or to enforce our Terms of Service.
• Business transfers. If we are involved in a merger, acquisition, financing, reorganization, or sale of all or part of our assets, information may be transferred as part of that transaction, subject to the protections of this Privacy Policy.

6. Cookies and Similar Technologies

The Site uses cookies and similar technologies to operate the Site, remember your preferences, analyze usage, and improve performance. You can typically configure your browser to refuse or delete cookies; however, doing so may affect the functioning of the Site. Third-party services embedded on the Site (such as Calendly and Wistia) may set their own cookies subject to their respective privacy policies.

7. Outbound Email and Compliance

Our outbound email programs are operated on owned sending infrastructure registered in our or our clients' names. We design our outbound to be compliant with applicable B2B commercial email laws, including the U.S. CAN-SPAM Act and Canada's Anti-Spam Legislation (CASL) where applicable. Every campaign email contains a functioning opt-out mechanism and identifying sender information. We honor opt-out requests promptly and maintain suppression lists to prevent re-contact.

If you believe you received a commercial email from a Fabgen-operated domain in error or you wish to be removed from current and future campaigns, please email adrury@fabgen.ai with the sending address and we will suppress the relevant contact within five (5) business days.

8. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. When we no longer need to retain information, we delete or anonymize it.

9. Data Security

We maintain reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, disclosure, alteration, and destruction. No method of transmission over the internet or method of electronic storage is fully secure, however, and we cannot guarantee absolute security.

10. International Transfers

Fabgen is based in the United States. If you access the Site or interact with the Services from outside the United States, your information may be transferred to, stored, and processed in the United States and in other jurisdictions where our service providers operate, which may have data-protection laws that are different from those in your jurisdiction. Where required by law, we put in place appropriate safeguards for international transfers.

• Access the personal information we hold about you;
• Request correction of inaccurate or incomplete personal information;

The Site and Services are intended for business users and are not directed to children under the age of 16. We do not knowingly collect personal information from children. If you believe a child has provided personal information to us, please contact us so we can promptly delete it.

The Site may contain links to third-party websites and services that are not operated by Fabgen. We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policies of any third-party site you visit.
